Sunbury County Probate Index -

These indexes shows a list of Probate Records on file at The Provincial Archives of New Brunswick. You will have to contact them to get a copy of the file, or to request a film on inter-Library loan. You can find  a list of Probate Records for some of the other Counties which are online, by searching the NB GenLinks site.

Probate file may contain any of the following, and not necessarily all of them -

  • Wills - not all files contain wills, although most do.
  • Administration Papers - These were issued by the Judge of Probate when a will was presented to him, or a request was made to him to administer the estate of a deceased person (some of who may have died without a will / Intestate). These papers usually contained a brief statement of who died, when and where, plus the name(s) of the person(s) making the application, and on occasion their relationship to the deceased.
  • Details of the estate left - these papers give an insight into the property left by the deceased, and on occasion (especially in the case of an Intestate Estate) may list many heirs.

Not all wills went to Probate. If a person died with a minimun of property, and the transfer was simple, the will could be taken to the Land Registry Office. There it would be placed on file, and the ownership of the property in question was simply entered into their record books. So for this reason you will find a few wills recorded in the County Registry Offices that never went to the Probate Courts. You might also find records in the Registry Office where heirs "signed off" a piece of property in favour of a single heir, or for the sale of the deceased person's property.
